“Muslim ban”: Justice resists, Trump roars

Editorial published on February 10, 2017

Among the “executive orders”, President Trump signed on 27 January a 90-day ban on travel into the United States from seven Muslim countries (Iran, Iraq, Libya, Somalia, Sudan, Yemen and Syria) because of national security issues. Demonstrations against this migratory ban, in the United States and abroad, showed an important rallying of civil society.

On 3 February, Trump experienced his first setback when federal judge James Robart blocked the immigration order after the Minister of Justice of Washington State lawsuit against the travel ban. This temporary suspension allowed the citizens of the seven countries to travel again to the United States.

The Court of Appeal of San Francisco rejected the request of Trump’s administration. As usual, Trump violently backfired on his Twitter account calling Robart a “so-called judge“* and insisting: “If something happens, blame him and court system.“**

On February 9, the Court of Appeal of San Francisco decided to maintain the suspension of the migratory ban. Trump’s reaction was: “See you in court“. The government can appeal to the Supreme Court for a final judgment.
